The captain can intervene whenever intoxication becomes a safety problem. Having a captain means guests don't operate the boat, but it doesn't remove the risks of falling, swimming while impaired, dehydration, or ignoring safety instructions. A private charter is not a maritime diplomatic immunity zone.
